Terms of Service

These terms govern access to and use of the Votarena site and services. They form a contract between you and Votarena — [registered name, legal form], [address] (“Votarena”, “we”).

1. Purpose and acceptance

By creating an account, voting, buying a ticket or otherwise using the service, you accept these terms in full. If you do not accept them, do not use the service. You confirm that you have the legal capacity to enter into a contract; if you act on behalf of an organisation (association, company, promoter), you warrant that you have the authority to bind it.

2. Description of the service

Votarena is an online platform that lets you:

  • organise and follow paid-vote competitions (contestants, rounds, eliminations, rankings);
  • vote for a contestant by paying with Mobile Money, Wave or bank card;
  • publish events and sell their tickets (QR-code tickets, partner stands, promotional codes);
  • track sales and balances, and request their payout.

Votarena is a technical intermediary: we provide the tool, the payment collection and the audit trail. We are neither the organiser, nor the producer, nor the jury of the competitions and events published by users.

3. Account

  • Creation: creating an account requires a name, a valid email address and a password, or a sign-in through Google, Facebook or Apple. An account is personal — it may not be shared, lent or transferred.
  • Voter / organiser: every account is created as a voter. Organiser status, which unlocks the management area (creating competitions and events, sales, withdrawals), is obtained through the “Become an organiser” journey.
  • Accuracy of information: you undertake to provide accurate information and to keep it up to date, in particular the phone number used for payments and ticket delivery. Incorrect information may prevent a ticket from being delivered or a payment from being matched.
  • Security: you are responsible for keeping your password confidential and for any activity carried out from your account. Tell us without delay if it is used without your authorisation. We will never ask you for your password or a payment code by message.
  • Buying without an account: ticketing is open to guests. Your tickets are then tracked through your browser; they can be attached to an account when you sign in later.

4. Role and obligations of organisers

The organiser is solely responsible for the competition or event they publish, for holding it and for its content. They undertake to:

  • publish accurate and complete information (rules, dates, venue, prices, ticket categories, admission conditions) and keep it up to date;
  • hold the authorisations, licences and insurance required by the regulations applicable to their event;
  • hold the rights to the images, music, trade marks and likenesses they publish, including contestants’ photos;
  • apply the announced rules fairly (rounds, eliminations, tie-breaks) and not change them along the way to the detriment of participants or voters;
  • honour the event sold, handle their buyers’ requests and bear the consequences of a cancellation or postponement;
  • use buyers’ and voters’ data only to run the event, in compliance with the applicable regulations.

The organiser may appoint co-managers and approvers (ticket checks at the door). They are answerable for their actions as for their own.

5. Paid votes

  • Price: voting is paid for. The unit price and the total amount are shown before payment; no amount is charged without that confirmation.
  • A vote is final: once payment is confirmed, the vote is counted and cannot be cancelled, changed or transferred to another contestant.
  • Non-refundable: votes are not refundable, including where the contestant is eliminated, the rules change, the wrong recipient was chosen or the outcome is disappointing. Only a charge with no vote counted (technical failure) gives rise to a correction, on a substantiated claim.
  • No guaranteed outcome: voting guarantees neither qualification, nor victory, nor any advantage. A vote is not gambling, a bet or an investment; it gives no right to any winnings.
  • Fair play: fraud (automation, multiplying accounts or numbers to get around limits, abusive payment disputes) leads to the cancellation of the votes concerned, without refund, and to the suspension of the account.

6. Ticketing

  • Named ticket: the ticket is issued in the name of the buyer or of the beneficiary given. Reselling it above its price is prohibited; the organiser may ask for identification at the door.
  • Single-use QR code: every ticket carries a QR code (and a short code) valid once only. Once checked at the door, it is burned and no longer grants admission. Do not share the image of your ticket publicly: the first presentation wins, and we cannot arbitrate between two holders of the same code.
  • Non-refundable: tickets are neither refundable nor exchangeable, except where the event is cancelled by the organiser. In that case the refund is owed by the organiser; Votarena helps process it, up to the sums still held on their behalf.
  • Postponement or change: if the event is postponed, the ticket remains valid for the new date, unless the organiser states otherwise.
  • Promotional codes and invitations: discounts and complimentary tickets are issued by the organiser, in limited numbers, and may be withdrawn at any time as long as they have not been used.
  • Admission: admission to the venue remains subject to the organiser’s house rules and safety instructions; they may refuse entry to a ticket holder who breaches them.

7. Fees, payouts and withdrawals

  • Collection: payments are collected through our providers (Mobile Money, Wave, bank card), on behalf of the organiser.
  • Organiser’s share: the sums belong to the organiser, less Votarena’s commission and the payment provider’s fees. The applicable detail (unit share per vote, percentage on tickets, fee rate and which party bears it) is shown in the management area before going live.
  • Withdrawals: balances are paid out on request from the management area. A request may be refused or put on hold where fraud is suspected, a dispute is ongoing, an event has not been held or account information is inconsistent.
  • Timescales: timescales depend on the provider and the mobile operator; they are indicative and cannot bind Votarena.
  • Taxes and duties: each organiser is responsible for their own tax and reporting obligations.

8. Content and publication

Your content remains yours. You keep ownership of the texts, photos, videos and images you publish. You warrant that you hold the necessary rights and that this content is not unlawful, defamatory, hateful or misleading, and does not infringe the rights of third parties.

Licence granted to Votarena. By publishing content, you grant Votarena a non-exclusive, royalty-free, worldwide licence to host, reproduce, technically adapt (resizing, compression, thumbnails), display and distribute that content on the service as well as in its promotional communications (site pages, social media, information messages), for the duration of the publication and for as long as archiving requires.

Editorial publication by Votarena, including in the organiser’s name. You expressly authorise Votarena to write and publish editorial content — news, announcements, date reminders, features, reports and results — on the pages of the approved competitions and events you organise or take part in, including under the organiser’s name, for the sole purpose of promoting the event and informing the public. This applies within the following limits:

  • the content published remains factual and faithful to the information supplied by the organiser or already public;
  • it creates no new obligation for the organiser and does not commit them beyond what they have themselves announced (no price, no promise, no contractual undertaking);
  • it carries neither advertising for a third party nor any stance taken on the organiser’s behalf;
  • the organiser may at any time ask for such content to be changed or removed, from their management area or in writing to durin@tasondock.com; Votarena acts on this within a reasonable time, in principle within [48] working hours;
  • the organiser may also object in advance to any publication in their name, by telling us at the same address; the objection applies to all of their competitions and events.

Prohibited content. The following are prohibited in particular: hate, harassment, unsolicited nudity, counterfeiting, impersonation, false information about an event, scams and the sale of unlawful goods. Votarena may remove, unpublish or hide any content that breaches these terms or the law, and report the facts to the competent authorities.

9. Moderation, approval and checks

Publishing a competition or an event publicly is subject to approval by the Votarena team. We may refuse, suspend or withdraw a competition, an event, a contestant or a partner stand — in particular where information is inconsistent, fraud is suspected, buyers complain, an authorisation is missing or these terms are breached. Such decisions give no right to compensation. A decision may be challenged in writing at durin@tasondock.com.

10. Intellectual property

The site, its brand, its logos, its interface, its texts and its code are the property of Votarena and are protected. No reproduction, extraction, automated scraping, reverse engineering or commercial reuse is allowed without our written agreement. Organisers’ trade marks and images remain their property.

11. Personal data

The processing of your personal data is described in our privacy policy, which forms an integral part of these terms. Where an organiser receives buyer or voter data, they become the controller for their own uses and must comply with the applicable regulations.

12. Liability and limitations

  • The service is provided “as is”. We do not guarantee uninterrupted availability, the absence of errors, or compatibility with every device or network.
  • Votarena is not responsible for the holding, quality, cancellation or content of the events and competitions, which are down to the organisers, nor for the statements and content published by users.
  • We are not answerable for failures of Mobile Money operators, payment providers, networks or third-party services, nor for the consequences of a wrong number entered by you.
  • To the extent permitted by law, any liability on our part is capped at the sums you have actually paid us in respect of the disputed transaction.
  • No limitation applies in the event of gross negligence, wilful misconduct or infringement of rights that the law makes non-excludable.

13. Suspension and termination

You may stop using the service and ask for your account to be deleted at any time. We may suspend or close an account in the event of a breach of these terms, fraud, non-payment, risk to other users or a legal requirement — where appropriate after prior notice, save in an emergency. Closing an account gives no right to a refund of votes already counted; valid tickets issued before closure are still honoured. Some data is kept for our accounting and evidential obligations.

14. Changes to these terms

We may change these terms, in particular to keep up with changes to the service or to the regulations. The update date appears at the top of the page; where a change is significant, we will tell you by a reasonable means. Continuing to use the service after it takes effect counts as acceptance. Transactions already completed remain governed by the version in force on the day of payment.

15. Governing law and disputes

These terms are governed by Cameroonian law. In the event of a dispute, the parties will first try to reach an amicable solution: send your claim to durin@tasondock.com; we undertake to reply within a reasonable time, in principle within [15] days. Failing agreement, the dispute will be brought before the competent courts of [city], Cameroon, subject to the mandatory rules protecting consumers.
